Rajendrasinh vs State

Heard learned advocate Mr. Jadeja for learned advocate Mr. Majmudar for the applicant.

It is submitted that the accused gave undertaking to pay the amount advanced to the other borrowers including himself and pursuant to that the cheque in question was given and hence the trial Court committed error in recording that the cheque was given towards security.

In view of above, leave to appeal is granted. This application stands disposed of.
