Mr.Raval, learned APP for the respondent - State tendered a communication dated 21.1.2012 prepared by PSI Bavla - Mr.CA Parmar and addressed to the Government Pleader of this Court. The report, contains details about the investigation made in this matter and, ultimately, on 10.7.2011, even chargesheet came to be filed before the concerned Magisterial Court. It is submitted that during the course of investigation, muddamal Dumper - truck bearing registration No.GJ-13W-753 could not be seized. Heard Mr.Chintan Buddhadev, learned advocate for Mr.Satyen B.Raval, learned advocate for the applicant.
In the above view of the matter, when the chargesheet is already filed before the competent Court having power to take cognizance, the applicant shall be at liberty to take appropriate steps before the concerned Magisterial Court.
With above observations, the instant petition stands disposed of. The communication dated 21.1.2012, referred to above in this order, shall be retained on record. D.S permitted.
