Rajendra And Another vs The District Magistrate

High Court Of Judicature at Allahabad|24 August, 2018

JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 8751 of 2003 Petitioner :- Rajendra And Another Respondent :- The District Magistrate, Bulandshahar And Others Counsel for Petitioner :- Vinod Sinha Counsel for Respondent :- C.S.C.,N.Agarwal,N.K.Srivastava
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared to press this writ petition. Learned Standing Counsel is present for respondents. In the circumstances, I myself have perused the record.
2. By means of present writ petition, petitioners have sought following reliefs:
“(i) issue a writ, order or direction in the nature of certiorari quashing the order dated 10.02.2003, passed by the respondent no. 1, (containing Annexure No. 7 to the writ petition) in so far as it cancel the appointments of the petitioners and consequential order dated 14.02.2003, passed by the respondent no. 3 (contained in Annexure No. 8 to the writ petition),
(ii) issue a writ, order or direction in the nature of mandamus directing the respondents not to interfere with the working of the petitioners as Safai Karmchari in Nagar Panchyat, Chhatari, District Bulandshahar,
(iii) Issue a writ, order or direction in the natrue of mandamus directing the respondents to forthwith pay salary to the petitioners, as determined by the respondent no.1 vide order dated 10.02.2003 and to continue to pay the same regularly as and when it falls due;”
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioners are not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioners have lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioners is absent.
5. Dismissed. Interim order, if any, stands vacated.
