Heard learned counsel for the applicant, learned AGA for the State and perused the record.
This application under Section 482 CrPC has been filed by the applicant with the prayer to direct the Additional Chief Judicial Magistrate, Court No.1, District Meerut to decide the application dated 12.10.2017 filed by the applicant in Case No.882/2016 (State Vs. Shayam Veer) under Section 420, IPC, arising out of Case Crime No.383 of 2014, P.S. Nauchandi, Meerut.
Learned counsel for the applicant has submitted that applicant Rajendra has lodged first information report against four nominated accused persons namely, Shayam Veer Singh, Smt. Rajbala, Ram Veer Singh and Smt. Urmila. On the basis of first information report investigation was made by the police and after concluding investigation charge sheet was submitted only against Shayam Veer Singh. On the basis of the said charge sheet cognizance was taken against Shayam Veer Singh. During the pendency of the aforesaid proceedings an application has been filed by the applicant to summon other co-accused against whom charge sheet has not been filed. The said application dated 12.10.2017 is still pending disposal and it is prayed that the court below be directed to decide the said application.
Considering the facts and circumstances of the case, Additional Chief Judicial Magistrate, Court No.1, District Meerut may consider the aforesaid application dated 12.10.2017 expeditiously in accordance with law and pass appropriate orders.
With these observations, the present application under Section 482, Cr.P.C. is disposed of.
