Heard learned counsel for the petitioner, Mr. Arvind Kumar Goswami, learned counsel for Union of India, learned Standing Counsel for the State and perused the record.
Learned counsel for the petitioner submitted that mobile tower is going to be installed near the school and near the dense locality of village, which is against the guidelines issued by the Government of India and the Pollution Control Board. However, in spite of oral and written complaint, no appropriate step has been taken to change the place. Hence, mandamus be issued directing the respondents not to activate or install the mobile tower near the school and dense locality of village.
Learned counsel for Union of India submitted that there is no violation and installation is as per guidelines and it is not in the premises of the school.
Considering the facts and circumstances of the case, it is provided that if an application/complaint is moved before the respondent nos.3 and 4, it is expected that appropriate step may be taken after considering the fact whether installation of mobile tower is in compliance of guidelines issued by Government of India and the Pollution Control Board or against the guidelines and against the interest of the public.
With the aforesaid observation, this petition is finally disposed off.
