JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 33190 of 2002 Petitioner :- Rajendra Singh Respondent :- Union Of India Ministry Of Home Affairs And Ors. Counsel for Petitioner :- Subhash Mani Tripathi,M.K. Tiwari Counsel for Respondent :- S.S.C.,Ashok Singh
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared to press this writ petition. Learned Standing Counsel and Sri Ashok Singh, Advocate are present for respondents. In the circumstances, I myself have perused the record.
2. By means of present writ petition, petitioner has sought following reliefs:
“1- To issue a writ, order or direction in the nature of certiorari quashing the impugned Notional Promotion list dated 27-11-2000 (Annexure No.-1) as well as seniority list of the post of Naik Prepared by the C.I.S.F. Department.
2- To issue a writ, order or direction in the nature of mandamus commanding the respondents to amend the Notional Promotion list as well as to amend the Seniority list of the post of Naik issued by the C.I.S.F. Department by placing the petitioner more Senior to the juniors, in accordance with law.
3- To issue a writ, order or direction in the nature of mandamus commanding the respondents to promote the petitioner by virtue of the seniority, from the date on which, his juniors have been promoted to the higher post as well as arrears of payment of salary from the date of promotion, may kindly be directed to be paid, together with 18% interest thereon.”
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
