Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.
In a proceeding instituted under Rule 109 of U.P. Consolidation of Holdings Rules, 1954 by one Meva Lal, petitioner submitted objection which was rejected by the Consolidation Officer, Etawah by order dated 05.11.2020.
Against the order dated 05.11.2020, petitioner preferred statutory appeal which is numbered as 52 of 2020 in which petitioner has also filed stay application with a prayer for staying the order dated 05.11.2020.
The grievance of the petitioner is that his stay application has not been decided and in case, the order dated 05.11.2020 is executed, the appeal shall be rendered infructuous.
Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to the competent authority to consider the grievance of the petitioner.
Considering the facts and circumstances of the case and with the consent of the parties, the writ petition is disposed off with a direction to respondent no.3- Settlement Officer of Consolidation, Etawah to decide the stay application of petitioner filed in Appeal No.52 of 2020 on next date fixed i.e. 13.01.2021. If for any reason the stay application could not be decided on the date fixed, the respondent no.3 shall endeavour to decide the same expeditiously, preferably within a period of two months thereafter.
The writ petition is disposed off subject to the observations made above.
