This writ petition, inter alia, has been filed for the following reliefs;
"1- Issue a writ order or direction in the nature of certiorari quashing the impugned recovery notice 30-1-2018 issued by Respondent No. 3 of Rs. 24,43,193/- (Annexure No. 2 to this writ petition).
2-Issue a writ, order or direction in the nature of mandamus directing the respondent No. 3 to permit the petitioner deposit the entire amount in an easy installment as fixed by this Hon'ble Court."
By order dated 23.7.2018, this Court had directed the learned counsel for the respondents to seek instructions in the matter. Today Mr. Baleshwar Chaturvedi, learned counsel for the respondents produced certain documents indicating that the petitioner had filed his objection by letter dated 8.1.2018 which has already been decided by the Respondent No. 3, Executive Engineer. The Respondent No. 3, Executive Engineer, after considering his objection dated 8.1.2018, has passed the final assessment order dated 27.7.2018.
Since the final assessment order dated 27.7.2018 has been passed, the petitioner, if so advised, may file an appeal under Section 127 of the Electricity Act, 2003 in accordance with law.
It is further provided that in case any such appeal is filed by the petitioner, it may not be dismissed merely on the ground of delay.
With this observation, the writ petition stands finally disposed of.
