Heard Sri Brijesh Kumar Yadava, learned counsel for the petitioner and Ms. Arti Gupta, State Law Officer.
The petitioner is a resident of village Himaupur, Block & Tehsil Fatehabad, District Agra and is also a ration card holder entitling him for essential commodities under the Public Distribution Scheme from the fair price shop of the said village.
According to petitioner, respondent no.5, the fair price shop agent of the aforesaid village, is not distributing the food grains and essential commodities properly and accordingly, the petitioner has submitted a representation/complaint to the District Magistrate as well as District Supply Officer Agra but they have not paid any heed to the said representation of the petitioner.
Learned counsel for the petitioner submits that authorities may be directed to consider the representation of the petitioner.
Ms. Arti Gupta, State Law Officer, contends that petitioner has a forum called Grievance Redressal System contemplated Rule 4 of Chapter 3 of U.P. Food Security Rules, 2015 (hereinafter referred as "Rules, 2015") for redressal of grievance, if the petitioner has any grievance, he can approach the District Grievance Redressal Officer, who shall endevour to decide the complaint/representation as per Rule 5 of the Rules, 2015. The submission is that the writ petition at this stage is not maintainable as petitioner has statutory alternative forum for redressal of his grievance.
In view of the statutory alternative forum available to the petitioner, the writ petition is disposed off with liberty to the petitioner to approach District Grievance Redressal Officer by filing a representation raising all his grievances within a period of three weeks from today.
In case, the petitioner submits any such representation, it is expected of the District Grievance Redressal Officer that he will abide by the time limit for disposal of the complaint as provided in Rule 6 of Rules, 2015.
