This criminal revision has been moved on behalf of revisionist seeking the quashing of judgement and order dated 10.01.2018 passed by the learned Judge Family Court/ Additional District & Sessions Judge (F.T.C.), Court No.2, Jhansi in Case No.191 of 2012 (Smt. Preeti & Another vs. Rajendra Singh), u/s 125 Cr.P.C., P.S.- Tahrauli, District-Jhansi, whereby the application moved u/s 125 Cr.P.C. on behalf of opposite parties has been allowed and the revisionist has been directed to pay Rs.5000/- to his wife and Rs.5,000/- to his son per month from the date of order.
Heard learned counsel for the revisionist.
Submission of counsel is that in fact the revisionist is prepared to pay the maintenance amount also but the same may be lowered.
Heard learned A.G.A. and also perused the record.
Perusal of the impugned order reveals that the same cannot be reprimanded on any valid ground. So far as the final amount of maintenance is concerned, counsels for revisionist agreed to make some modulation in the same and in that view of the matter this Court deems it proper to reduce the maintenance amount of Rs.5000/-, as has been directed by the court below to be paid to the wife, to Rs.4000/- and to enhance the amount in favour of child from Rs.5000/- to Rs.6,000/-. Now the revisionist would be liable to pay Rs.4000/- to the wife and Rs.6000/- to the son per month as maintenance amount.
The present revision stands disposed of in aforesaid terms.
