Heard learned counsel for the applicant and learned A.G.A. for the State.
The present writ petition has been filed to quash the order dated 02.01.2018 passed by the Addl. Session Judge, Fast Track Court No. 1, Agra in Criminal Revision No. 454 of 2017 (Rajendra Singh Vs. State of U.P. and another) arising out of order dated 22.05.2017 in Case No. 3346 of 2016 / 4886 of 2016 (State Vs. Bijrendra Singh and others) in Case Crime No. 326 of 2013, under Sections- 420, 467, 468, 471, 120-B I.P.C., Police Station- Tajganj, District- Agra, pending in the court of A.C.J.M.-III, Agra.
It has been stated by learned counsel for the petitioner that after filing of the present petition, the petitioner has been arrested and is in jail. Therefore, the present writ petition has become infructuous and it may be dismissed as such.
Accordingly, the present petition is dismissed as having become infrucutous, leaving it open to the petitioner to apply for bail.
