Heard learned Counsel for the petitioner and learned Standing Counsel.
Petitioner is a farmer in District Sambhal. During the previous rainy season, due to over flooding of the river, his agricultural land was sub-merged with river water. After escaping of water, the sand had remained on his land, due to which, he is unable to cultivate it.
The petitioner wants either the aforesaid sand be removed by the State authorities or he may be permitted to remove it.
The petitioner in order to get the sand removed from his agricultural land, applied to the District Magistrate, Sambhal under Rule 52 of the U.P. Minor Minerals (Concession) Rules, 1963. The application has been submitted in prescribed form along with the affidavit on 6.6.2018, but till date no action has been taken on it.
In view of the aforesaid facts and circumstances, we dispose of this petition with the direction to the respondent no.2, District Magistrate, Sambhal to consider the aforesaid application of the petitioner and the subsequent reminders, in accordance with law most expeditiously, if possible, within a period of six weeks from the date of production of certified copy of this order.
