JUDGMENT / ORDER

JUDGMENT G.P. Srivastva, J.
1. Heard learned Counsel for the applicant and learned A.G.A. 2 Nandita Adawal learned Counsel for Op. P.
2. The prosecution case shows that the applicant who is police personnel posted in the same police station as head constable clerk accompanied with co-accused in the night of 23/24.1.06 at about 12.30 forcibly got the door of the house of the victim open, covered the husband of the victim with Katta and the co-accused raped the victim. Thereafter the applicant also attempted to rape but due to intervention of persons of locality he could not do so and he was caught by the public on the spot. In the injury report a number of injuries were noticed on the body of the victim who is a married lady. She had narrated the entire tale in her statement under Section 164 Cr.P.C. The applicant instead of protecting committed heneous offence against a poor lady. The applicant does not deserve bail. The bail application is rejected.
