Heard learned counsel for the petitioners and learned Additional Government Advocate.
Under challenge is FIR relating to Case Crime No. 798A of 2009, under Sections 147,148,149,394,323,504,506,427,& 436 IPC, police station Kotwali Ayodhya, district Faizabad.
We have gone through the contents of the FIR of the present case and also the FIR relating to case crime No.798 of 2009, under sections 452,323,504 & 506 IPC,P.S.Kotwali Ayodhya, district Faizabad with respect to the incident which is said to have taken place between the parties on 29.4.2009. Arguments advanced by the learned counsel for petitioners is that the FIR which is lodged by respondent no. 3 has been lodged with the aid of Section 156 (3) Cr.P.C, as such,no incident as alleged has taken place. Long standing dispute of civil nature is also going on between the parties. Since the parties have also received injuries, and the FIR also discloses commission of a cognizable offence, as such, we do not find any ground to quash the FIR The petition is misconceived and is accordingly dismissed. However, it is provided that if petitioners surrender and move applications for bail, their applications shall be considered and disposed of expeditiously be the courts below.
