The sole relief claimed in the instant petition is for issuance of a direction to the Court of Small Causes before whom Execution Case No. 10A/2013 - Rajendra Rawat and others Versus Mata Prasad, is pending, to decide the same, expeditiously.
The petitioners have obtained a decree of eviction against the respondent-tenant in SCC Suit No. 2/2005. The same is under execution. The revision filed by the tenant against the main judgment was dismissed long back on 19.2.2010. Thereafter, writ petition filed by him before this Court was also dismissed on 24.5.2010, but since then, the tenant had succeeded in delaying the execution proceeding.
Having regard to the facts of the case, the petition is disposed of by directing the Executing Court to ensure that the execution proceedings are taken to their logical conclusion expeditiously, without granting unnecessary adjournments to the parties.
