Heard learned counsel for the petitioners and the learned Additional Government Advocate.
This petition has been filed by two persons namely Rajendra @ Rajan Mishra and Neelkanth Mishra in Case Crime No.295 of 2010 under Sections 326, 504, 506 IPC, Police Station Achalganj, District Unnao.
In para 1 of the writ petition, it has been stated that this is the first writ petition for quashing the FIR relating to aforesaid crime number. It has been brought to the notice of the court that the petitioners had already filed Writ Petition No.1730(M/B) of 2010, which is pending.
We have called the file of the aforesaid case and found that it is true that Writ Petition No.1730 (M/B) of 2010 has been filed by the petitioners but the matter has been concealed from the court.
Accordingly, this petition is dismissed with costs of Rs.50,000/- to be recovered from the petitioners by the District Magistrate, Unnao within one month as arrears of land revenue and the costs shall be deposited in the Mediation and Conciliation Centre of this Court, by the District Magistrate within the aforesaid period.
