Heard Shri Abhishek Kumar Yadav, learned counsel for the petitioner, learned standing counsel for the respondents no. 1 to 4 and Shri Manoj Kumar Yadav, learned counsel appearing for the respondent no. 5.
The petitioner in the writ petition is seeking a direction to the respondents to remove the illegal encroachment from the Gaon Sabha Land of village Sarpatahan Tehsil Shahganj District Jaunpur i.e. Gata No. 95, 116, 767, 768 area 0.040 hectare, 0.336 hectare, 0.040 hectare and 0.047 hectare respectively recorded as Nali, Gata No. 105 area 0.085 hectare recorded in the revenue record as Chak Marg and Gata No. 117 area 0.089 hectare recorded as Banjar. The relevant extract of revenue record has been filed as Annexure-2 to the writ petition.
No useful purpose would be served in keeping this writ petition pending.
This writ petition is therefore disposed of with a direction to the respondent no. 4-Tehsildar Tehsil Shahganj District Jaunpur to enquire into the matter and take appropriate action in accordance with law within a period of two months from the date of receipt of the certified copy of this order.
It is made clear that the court has not adjudicated the claim of the petitioner on merit.
