Heard Sri S.K. Verma, learned Senior Advocate assisted by Sri Udai Chandani on behalf of the petitioners, Sri Rajesh Yadav for respondents 1 to 4 and Sri Bipin Bihari Pandey for respondents 5 and 6. With their consent, the instant petition is being disposed of finally at this stage itself as follows :-
The order passed by the second Appellate Court dated 13.8.2019, impugned in the instant petition shall stand set aside. The second Appellate Court shall decide the appeal itself on merits within a period of four weeks from the date of production of a certified copy of this order.
In the meantime, counsel for the petitioners as well as the private respondents have undertaken not to create any third party right in the property in dispute.
