Heard learned counsel for the petitioners.
The grievance of the petitioner is that the respondent no. 3 without acquiring any portion of his Gata No. 247 situated at village Kiratpur, Tehsil Bharthana, District Etawah is carving out a Chakroad through his aforesaid plot.
It has been contended by the learned counsel for the petitioner that his plot has neither been acquired nor he has been paid any compensation by the respondent no. 3.
In view of the above, without expressing any opinion on merits, we dispose of this writ petition with liberty to the petitioner to file a representation before the respondent no. 2 District Magistrate, Etawah ventilating his grievance within a period of two weeks from today along with certified copy of this order. In case any such representation is filed by the petitioner before the respondent no. 2 within the period stipulated hereinabove, he shall consider and decide the same strictly in accordance with law by a reasoned and speaking order. It is further provided that till the representation made by petitioner before the respondent no. 2 is decided, the petitioner shall not be dispossessed from his plot except by procedure prescribed under law.
