Heard learned counsel for the petitioner and learned Standing counsel for the State-respondents.
The petition has been filed seeking the following relief-
"a) Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 to decide Case No.T201714365845795 of 2017, Rajendra Prasad Versus Jagat Narain and others, under Section 116 of U.P. Revenue Code, expeditiously as possible as within short stipulated period which is pending in the Court of Sub Divisional Magistrate, Sadar, District Jaunpur."
The petitioner seeks directions for expeditious disposal of his partition suit, which is stated to have filed in November 2017.
Perusal of the order sheet of the proceedings appended to the writ petition reveals that the written statement has not been filed by the defendants, although they appear to have been served. It therefore, follows that the issues have not been framed, neither the parties have led their evidence.
Under the circumstances, this writ petition is disposed of directing the respondent no.2, Sub Divisional Magistrate, Sadar, District Jaunpur. to endeavour to decide the partition suit of the petitioner, expeditiously, preferably within a period of eighteen months from the date a certified copy of this order is filed before him.
