Heard learned counsel for the applicant.
The petitioner is before this Court for a direction to initiate contempt proceeding against the respondents for disobedience of the order dated 16.04.2019 passed in Writ-A No.4935 of 2019 (Rajendra Prasad v. State of U.P. & Ors.). For ready reference the order dated 16.04.2019 is quoted as under:-
"He very fairly states that the recruitment in question is being held by a statutory body namely U.P. Higher Education Service Commission and since selection was initiated much before the notification of general election, therefore, the restriction placed by the Election Commission would not apply. According to him, the same would apply only to adhoc appointments.
In view of the fair stand taken by Sri B.N. Singh before this Court, there would now be no impediment in the way of respondent no.3 in notifying date for counselling and in proceeding to conclude the recruitment process. It is directed accordingly."
The Court has proceeded to peruse the record in question and finds no reason or occasion calling upon any proceeding under Section 12 of the Contempt of Courts Act, 1971.
The Application is totally misconceived and the same is accordingly dismissed. However it is always open for the applicant to move an appropriate application for expediting the proceeding before the Competent Authority.
