Heard Sri Abhinandan Kumar Pandey, learned counsel for the petitioner, Sri H.P. Srivastava, learned Additional Chief Standing Counsel for the State and perused the material brought on record.
The present P.I.L. has been filed by the petitioner, namely, Rajendra Prasad Pathak with the following prayer:
"Issue a writ, order or direction in the nature of mandamus commanding opp. parties to set the polling booth at Primary School at Junior High School situated in Revenue Village Vishawanath Gaon (Vishunath Gaon) instead of Primary School Gosaigaon, for citizen to cast their votes in upcoming U.P. Panchayat Election 2021."
At the very outset, learned Additional Chief Standing Counsel has pointed out that the prayer made in the present PIL has become infructuous as the Panchayat Election has already been held yesterday, i.e., 29.04.2021.
Learned counsel for the petitioner could not dispute said fact as pointed out by the learned Additional Chief Standing Counsel.
We have heard learned counsel for the parties and after going through prayer made in the petition and contents therein, we find that the Panchayat Election has already been held on 29.04.2021 and no further cause of action survives, hence, the present writ petition has become infructuous.
Accordingly, the present writ petition is dismissed as having become infructuous.
The party shall file computer generated copy of order downloaded from the official website of High Court Allahabad, self attested by it alongwith a self attested identity proof of the said person (s) (preferably Aadhar Card) mentioning the mobile number (s) to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of the computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
