Heard Sri. B. D. Mishra, learned counsel for the petitioner and Sri Vivek Ratan Agrawal, learned counsel for the respondents.
This writ petition has been filed by the petitioner praying for quashing of the order dated 27.05.2016 passed by respondent no.2, the Assistant General Manager, Financial Inclusion Department, Union Bank of India, Central Office, Nariman Point, Mumbai, whereby services of the petitioner are being alleged to be terminated from the post of Bank Mitra.
A counter affidavit has been filed on behalf of respondent nos.1 to 3, Union Bank of India and its Officers stating that the petitioner has never been employed / appointed by Union of India. The petitioner has entered into an agreement dated 07.03.2016 with M/s Fino Fintech Foundation, Navi Mumbai, Maharashtra. The agreement has been terminated on 26.05.2016 and the work which the petitioner was performing was in pursuance of the aforesaid agreement with the M/s Fino Fintech Foundation. The petitioner is not the employee of the Union Bank of India and cannot claim any relief against it.
From the agreement dated 07.03.2016 brought on record between petitioner and M/s Fino Fintech Foundation, it is clear that the petitioner was an agent / working as Bank Mitra for bringing business for the Bank in terms of the agreement with M/s Fino Fintech Consultancy Service.
Therefore, the petitioner cannot claim any relief against Union Bank of India. The petitioner may avail any other remedy available to him under law.
Writ petition stands dismissed.
