Petitioner has been placed under suspension on 12.6.2019 on the charge that he has failed to perform election duty. A chargesheet has also been served upon him on 13.11.2019. It is alleged that though petitioner has submitted reply to the chargesheet, but the enquiry has not been concluded so far. It is also stated that merely for three months amount of subsistence allowance was paid, whereafter even subsistence allowance is not being paid to him.
Learned Standing Counsel states that enquiry initiated against the petitioner would be got concluded, expeditiously.
In the facts and circumstances, noticed above, this writ petition stands disposed of with a direction upon respondent no.2 to ensure that enquiry initiated against the petitioner is concluded, within a period of four months from the date of presentation of a copy of this order. The concerned respondent shall also ensure that withheld amount towards subsistence allowance is also paid to petitioner, within a period of four weeks from the date of service of order. It goes without saying that subsistence allowance shall continue to be paid till the disciplinary proceedings itself are concluded.
The concerned Authority/Official shall verify the authenticity of computerized copy of this order from the official website of High Court Allahabad and shall act accordingly without waiting for submission of the certified copy of this order.
