Heard Sri Chandrajeet Yadav, learned counsel for the petitioner and Sri G.S. Chauhan, learned counsel for the respondents.
Petitioner has filed this petition seeking a writ, order or direction in the nature of mandamus directing the respondent nos. 2, 3 & 3 to take immediate action to eject the respondent no. 4 from the public utility land i.e. Arazi Nos. 427, 428 and 430.
Learned standing counsel for the State, Sri G.S. Chauhan on instructions from Sandeep Kumar Verma, Sub Divisional Officer, Koraon, Prayagraj submits that on 16.12.2020 said land was made free from encroachment in presence of the villagers by a team of revenue officials and the police. There is no reason to not to believe this report, therefore as the relief claimed by the petitioner has already been accomplished. Nothing survives in this petition to adjudicate the matter, and therefore this writ petition is dismissed.
Before parting, it is made clear that this report be brought on record during the course of the day. However, if it is found that this report is incorrect, petitioner will be free to file an application for revival of this petition along with relevant photographs and personal affidavit.
With the aforesaid observations, the petition is dismissed.
