JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 18090 of 2004 Petitioner :- Rajendra Prasad Giri And 3 Others Respondent :- U.P. Rajkiya Nirman Nigam Ltd. And Others Counsel for Petitioner :- A.P.N. Giri Counsel for Respondent :- C.S.C.,Vivek Saran
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared to press this writ petition. Learned Standing Counsel is present for respondents. In the circumstances, I myself have perused the record.
2. By means of present writ petition, petitioner has sought following reliefs:
“(i) issue an order direction or writ in the nature of certiorari to quash the impugned order dated 30-5-2000 passed in pursuance of High Court order dated 27-8-99 by which justice may be done.
(ii) issue an order direction or writ in nature of mandamus commanding the respondents to pay the consolidated revised pay scale of Rs. 775-1067 to petitioner no. 1 & Rs. 775-940 to petitioner no. 2, 3 and 4 with effect from 1-1-96 by which justice may be done.
(iii) issue an order direction or writ in nature of mandamus commanding the respondent to regularise the service of petitioner as per undertaking of respondent in writ petition no. 5623 of 1999 to regular the petitioners.
(iv) issue an order direction or writ in nature of mandamus commanding the respondents to pay the difference of arrear to the petitioner since 1-1-96 arising out due to revision of pay and other consequential benefit by which justice may be done with the petitioners.”
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
