JUDGMENT / ORDER

CIVIL MISC. SUBSTITUTION APPLICATION.
Respondent no. 1 died on 17.9.2009 leaving behind his four sons, namely, Lal Bachan Rai, Gorakh Nath Rai, Vijai Shankar @ Brij Bihari and Suresh Rai as legal heirs. Out of the aforesaid sons, Lal Bachan Rai and Gorakh Nath Rai are already arrayed as respondent nos. 2 and 3.
Sri C.K. Rai, Advocate, states that he has no objection to the substitution application. He submitted that he has instruction from all the legal heirs of respondent no.1.
In view of the above, the application is allowed. In front of the name of respondent no. 1, the word since deceased be mentioned and Vijai Shankar Rai and Suresh Rai be impleaded/substituted as respondent nos. 1/1 and 1/2 with the endorsement that Lal Bachan Rai and Gorakh Nath Rai are already on record as respondent nos. 2 and 3.

CIVIL MISC. COMPROMISE APPLICATION.
Sri C.K. Rai, Advocate submitted that the parties have entered into compromise. An application has been moved in this regard along with the compromise deed. He requested that let the compromise application be sent to the trial court for verification.
In view of the above, the office is directed to send the compromise application to the trial court for verification. The parties may appear before the trial court on 28.5.2012. The trial court is directed to verify the compromise and send the report at the earliest.
