1. Heard Sri Ram Krishna Mishra, learned counsel for the petitioners and learned Standing counsel for the State.
2. The grievance of the petitioner is that they are owner in possession of gata Nos.517 M area 0.3290 hect. 518 M area 0.1520, 519 area 0.1640 hect. and 520 area 0.1640 hect. in revenue record of Village Salarpur Khadar Tehsil Dadari, District Gautam Budha Nagar.
3. It has been submitted that aforesaid land was subjected to acquisition and after acquisition the said land vested with Noida Authority. The aforesaid acquisition were challenged and by means of the judgment and order passed in Writ c No.66604 of 2009 dated 24.9.2010 this Court dismissed the writ petition which was further challenged before the Apex Court in Civil Appeal No.6353 of 2013 and the Hon'ble Apex Court by means of order dated 5.8.2013 set aside this Court's orders as well as the acquisition notification dated 11.9.2008 and 30.9.2009. Thereafter, the land ought to have been vested in the petitioners but the authorities did not proceed further in the matter and even today the land owned by the petitioners are recorded in the name of Noida Authority.
4. It is submitted that the petitioners and other similarly situated persons gave representations to the Additional District Magistrate but no action has been taken. It is further submitted that a direction be issued to Additional District Magistrate (Land Acquisition), District Gautam Budha Nagar to consider and decide the representation dated 23.7.2021.
5. Learned Standing counsel has no objection if such a direction is issued to the concerned authority.
6. Consequently, the present petition is disposed of with a direction to opposite party No.3 to decide the representation of petitioners dated 23.7.2021, expeditiously, preferably within two months from the date a copy of this order is placed before him in accordance with law and communicate his decision to the petitioners.
7. Needles to say that in case the representation is allowed, necessary correction in the revenue records shall be made.
8. With aforesaid direction the petition stands disposed of.
