JUDGMENT / ORDER

Learned counsel for the petitioner has confined the relief claimed in the writ petition to the expeditious disposal of the Suit No.491 of 2006 (Pankaj Trikewal vs. Rajendra Kumar Tekriwal) pending in the court of Civil Judge (Senior Division), Gorakhpur.
In view of the Division Bench of this Court in Km. Shobha Bose Vs. Judge Small Causes and others 2010 (1) ADJ 531 (DB), I do not consider it proper to issue straight way direction for the time bound disposal of the above suit. However, it will be open for the petitioner to approach the court concerned with an application in this regard and in case such an application is moved the courts below shall consider the same in accordance with law and ensure speedy trial of the suit looking to its roaster and the pendency of the earlier suits.
Writ petition is disposed of with above observation.
