This petition challenges an order of 1 December 2018 pursuant to which the petitioner, a Chakbandi Lekhpal has been temporarily attached to the Revenue Record Room at the Collectorate, Gorakhpur. Learned counsel referring to the provisions of Rule 23 of the U.P. Consolidation Lekhpal Service Rules, 2006 has contended that the impugned order has evidently come to be passed on the dictates of the District Magistrate since it clearly refers to an order passed by him on 21 May 2018. According to him, if the petitioner was to be moved within the district it could have been so ordered only by the Settlement Officer of Consolidation.
However, this Court finds no substance in this submission firstly since the order of 21 May 2018 has not been brought on the record. Fundamentally, the Court notes that the impugned order only refers to a temporary arrangement made and that too in the backdrop of three Chakbandi Lekhpals who had earlier been attached to the Record Room having been transferred. The fact that the petitioner could have been transferred within the district by the Settlement Officer of Consolidation is not disputed.
On an overall conspectus of the aforesaid facts, this Court finds no ground to interfere with the order impugned especially since it has been made in administrative exigencies.
The petition is dismissed.
