By means of present writ petition, petitioner is seeking a writ, order or direction in the nature of mandamus commanding the respondents to pay the claim of the petitioner along with interest at the rate of 12% per annum.
Learned counsel for the petitioner submits that the original petitioner died on 3.9.2010 during the pendency of the present writ petition. The substitution application to bring the legal heirs of the sole petitioner was filed and the same was allowed vide order dated 2.4.2019. He further submitted that the wife of the deceased-petitioner has already received the amount of G.P.F. and now she is only getting the interim pension. In the last learned counsel for the petitioner without touching the merits of the case prayed that opposite parties may be directed to take a decision on the other claim of the petitioner i.e. medical, gratuity and full pension.
Learned counsel for the State-opposite parties has no objection to the prayer regarding release of rest claim of the deceased-petitioner.
In view of above facts and circumstances and without entering into the merits of the case, the substituted petitioner is directed to submit a fresh and detailed representation before opposite party no.2 within one week from today along with certified copy of this order. If such a representation is made, the opposite party no.2 shall consider and decide the said representation by passing detailed and reasoned order, in accordance with law, within a period of three months from the date of receipt of the said representation.
The writ petition is disposed of accordingly.
