Heard Shri Sanjeev Singh, learned counsel for the applicant and Shri Rajesh Kumar Srivastava, learned counsel for the opposite party no. 3.
The applicant is before this Court for a direction to initiate contempt proceeding against the opposite party for wilful disobedience of the order dated 28.01.2021 passed in Writ A No.13838 of 2020 (Rajendra Awasthi Vs. State of U.P. And 3 Others).
Today when the matter was taken up, an affidavit of compliance has been filed by the opposite party no. 3, the same is taken on record. It is admitted between the parties that the order passed by the writ court has already been complied with, therefore, no cause of action remained survive.
An affidavit has also been filed by the Sanjeev Singh, counsel for the applicant stating therein that necessary amount as per the directions given by the Writ Court is received by his client.
In view of the same, the present contempt application is dismissed.
