Heard learned counsel for the petitioner.
By means of the present petitioner filed under Article 227 of the Constitution of India, the petitioner has challenged the order dated 21.8.2021 whereby his application for temporary injunction has come to be rejected in pending misc. appeal.
It is argued by learned counsel for the petitioner that there is chances of further sale of the property by defendant no. 2.
In the considered opinion of the Court every sale pending suit is covered under the law of lis pendens and it is always open for the petitioner to get the appeal finally decided which was filed against order rejecting 6-C application. I do not find any ground to interfere with the impugned order dated 21.8.2021.
However, in the facts and circumstances I hereby direct that court below shall proceed to decide the pending miscellaneous appeal quiet expeditiously, preferably within a period of three months from the date of production of copy of this order without being prejudiced by any observation made hereinabove after giving full opportunity of hearing to all parties concerned.
It is provided that a copy of the order available on the official website of the High Court will be taken to be authentic one.
