JUDGMENT / ORDER

Petition filed under Section 439 Cr.P.C.
2. The petitioner is the accused in Crime No.698/2014 of Vadakkekara Police Station, which has been registered for offences under sections 342, 376 and 506(ii) of IPC and section 66A of Information Technology Act.
3. The allegation against him is that he wrongfully confined the 1st informant, took off her clothes, took her nude photographs and threatened her into having sexual intercourse with her. He has thus committed the offences as mentioned above.
4. The submission made by the learned counsel for the petitioner is that the allegations are prima facie not believable and in view of the fact that he has been in custody since 7.6.2014, he may be granted bail.

5. Heard both sides.
6. The 1st informant is said to be aged 29 years. The applicant is aged 40 years. Prima facie he has committed the offences alleged against him. Annexure A - the copy of the remand report reveals that the petitioner is involved in other criminal cases. He has been convicted in one of the cases. It is further disclosed in the remand report that the firearm has been recovered from the house. The facts of the case indicate that releasing the petitioner on bail, at this stage, will certainly affect the investigation. It is not at all safe to release him on bail.
In the result, this application is dismissed.
