Heard Sri Lokesh Kumar Mishra, learned counsel for the petitioner, Sri J.P. Tripathi, learned A.G.A. appearing for the State, Sri Gyan Prakash, learned counsel for the C.B.I. and perused the impugned F.I.R. as well as material brought on record.
The relief sought in this petition is for quashing of the impugned F.I.R. No. RC0062018A0017 dated 26.07.2018, under Sections 120-B, 420, 467, 468, 471 & 511 I.P.C., police station C.B.I., S.P.E., Lucknow, District Lucknow.
Learned counsel for the C.B.I. opposed the prayer for quashing of the FIR and stated that two cases were registered against the petitioner as well as Mahesh Chandravanshi and one of the case which has been filed by Mahesh Chandravanshi has already been rejected and relief was granted only to his wife, Sandhya Katiyar.
After having examined the submissions advanced by learned counsel for the parties and perused the impugned FIR, we are of the opinion that the impugned FIR discloses cognizable offence against the petitioner, hence, no interference is called for by this Court in its extraordinary power under Article 226 of the Constitution of India for quashing of the FIR or for grant of any interim relief to the petitioner.
