Heard learned counsel for the applicant and learned A.G.A., for the State of U.P.
This application under Section 482 Cr.P.C., has been filed for quashing the summoning order dated 1.9.2014 passed by Additional Chief Judicial Magistrate, Court No. 7, Bareilly as well as entire proceedings of Complaint Case No. 1218 of 2013 (Smt. Hardei Vs. Rajeev Sharma and others ) under Sections 323, 504, 506 IPC, Police Station Subhash Nagar, District Bareilly.
This application has been filed at very belated stage. From the perusal of the material on record and looking into the facts of the case, at this stage, it cannot be said that no offence is made out against the applicant.
All the submissions made at the bar relate to the disputed questions of fact, which cannot be adjudicated upon by this Court in exercise of its extraordinary jurisdiction under Section 482 Cr.P.C.
After hearing the learned counsel for the parties and after perusing the averments made in the present application, the prayer for quashing the proceedings of the aforementioned case is refused.
However, it is provided that in case, the applicant claims discharge at appropriate stage, the same shall be considered and disposed of as expeditiously as possible in accordance with law, by the court concerned.
