Heard learned counsel for the petitioner; learned Additional Chief Standing Counsel for the State respondent.
Petitioner is before this Court with the request to command the District Basic Education Officer, Kushinagar to grant approval to appointment of the petitioner as Assistant Clerk in the Institution namely Rahul Shishu Shiksha Niketan Laghu Madhyamik Vidyalaya Kushinagar and to ensure arrears of salary as well as month to month salary to the petitioner.
Learned counsel for the petitioner has informed to the Court that with regard to his grievance petitioner has already made representations on 28.02.2017, 19.04.2017 and 23.02.2018 but the same are still pending consideration.
Learned Standing Counsel submits that in case any such approval is still pending, the same shall be considered and decided by the competent authority at the earliest.
In view of the above facts and circumstances, without entering into the merit of the case, on consent, the present writ petition is disposed of asking the District Basic Education Officer, Kushinagar to look into the grievance of the petitioner and pass appropriate order on the aforesaid representations of the petitioner within a period of two months from the date of production of certified copy of this order before him but certainly after taking call from the third respondent.
