This application has been filed seeking a direction to the learned Additional Chief Judicial Magistrate, 7th Ghaziabad for expeditious disposal of Case No. 9283 of 2014 'State vs. Rajeev Kaumr & another' (arising out of Case Crime No. 1128 of 2013) under Section 420 IPC & 60/72 Excise Act, P.S. Indirapuram, District Ghaziabad within a stipulated time.
The applicant is the accused. The crime is of the year 2013, and the case of the year 2014. The accused has a right to speedy trial of the case guaranteed under Article 21 of the Constitution. The case has been set down for final hearing but proceedings are lingering on. The Court has also been taken order sheet.
Looking to the fact and circumstances of the case, the Trial Court is directed to proceed with the case expeditiously and endeavour to conclude the same as early as possible without granting any unnecessary adjournment to either of the parties within a period of one year, if there is no legal impediment.
It is made clear that in case the witnesses are not appearing, the concerned court is directed to initiate necessary coercive measures to ensure their presence.
This application stand disposed of with the above direction.
