Heard learned counsel for the petitioner, learned Standing Counsel appearing for respondent nos. 1 and 2 and Sri Bhupendra Nath Singh, learned counsel appearing for respondent no. 3.
By means of the present writ petition filed under Article 226 of the Constitution of India, the petitioner has prayed for following main relief:
"Issue a writ or direction in the nature of Mandamus directing the respondent no. 1 (State of U.P. through its Principal Secretary Department of (Higher Education Government of U.P. Lucknow) to take a decision on report dated 3.3.2020 and 24.4.2020 submitted before him in pursuance to absorption of the petitioner."
The contention advanced by the learned counsel for the petitioner is that in spite of the fact that other persons have already been absorbed and are being paid salary in the regular pay-scale, the claim of the petitioner has remained pending.
Learned Standing Counsel has no objection in case a direction is issued to respondent no. 1 to consider the claim of the petitioner strictly in accordance with law in a time bound period.
Therefore, at this stage, the writ petition is disposed of with a direction that in case the petitioner prefers a fresh representation within three weeks from today in the light of prayer made in the writ petition and quoted herein above, the claim of the petitioner shall be looked into and duly addressed to by means of passing reasoned and speaking order within further period of six weeks.
