This application under Section 482 of Cr.P.C. has been filed by the applicant with the prayer to quash the impugned ex-parte order dated 15.2.2018 passed by learned A.C.J.M., Court No. 10, Allahabad in Complaint Case No. 482 of 2016, Smt. Ramyashi vs. Rajeev Kumar Singh, under Section 23 Domestic Violence Act, P.S.- Meja, District- Allahabad.
Heard learned counsel for the applicant and learned A.G.A. for the State. Perused the record.
Learned counsel for the applicant has not been able to point out any such illegality or impropriety, much less than any abuse of court's process which may persuade this Court to interfere in the impugned order. It appears that Rs. 3,000/- has been fixed as an interim maintenance to be given to the wife-opposite party no. 2 and the matter was fixed for evidence thereafter. In the present days of price hike such amount cannot be said to be either excessive or disproportionate. By the impugned order only interim maintenance has been given to the wife while the actual merits of the case are yet to be adjudicated upon through evidence that may be produced in the court and regular proceedings that shall follow. There is no good ground to interfere in the impugned order.
The application lacks merit and stands dismissed.
