This petition has been filed for a direction to the Additional District Judge-VII, Kanpur Nagar to decide the Election Petition No. 4 of 2017 (Rajeev Kumar Mehrotra Vs. State Election Commission and others) expeditiously.
It appears that the aforesaid election petition was filed under the provisions of Section 71 and 72 of the Nagar Nigam Adhiniyam, 1956, claiming a relief that in the municipal elections of 2017 of Kanpur Nagar, the election to the post of Corporator and the election result pertaining to Ward No. 79- Chatai Mohal, Kanpur Nagar be declared illegal and void and fresh elections be conducted. The certified copy of the order- sheet has also been appended to this petition.
It is contended by the learned counsel for the petitioner that the elections were held in the year 2017 and nearly two years have passed but the election petition is not being decided. It is contended that any further delay would render the election petition infructuous.
Considering the facts and circumstances of the case, the court below is directed to proceed expeditiously to decide the aforesaid election petition preferably within a period of eight months from the date of filing of a certified copy of this order passed today before it.
With the aforesaid observation, this petition is disposed of.
