Heard Shri Babu Lal Ram, learned counsel for the petitioner and the learned standing counsel for the respondents no. 1 to 4.
The petitioner in the writ petition is seeking quashing of the order dated 12.6.2018 whereby the additional charge of the post of District Panchayat Raj Officer, Budaun has been given to one Sewa Ram Choudhary, District Development Officer, Budaun. It is not the case of the petiitoner that he was regularly appointed on the post of District Panchayat Raj Officer. His contention however is that the charge of the other post of District Panchayat Raj Officer can be held only by the member of that Department.
We are not inclined to interfere with the matter. If the petitioner has any grievance he may represent before respondent no. 2- Director Panchayati Raj, U.P. Lucknow.
This writ petition is therefore disposed of with a direction that if the petitioner prefers a representation before the respondent no. 2-Director Panchayati Raj, U.P. Lucknow in respect of his grievance as raised in the present writ petition within fifteen days from today alongwith the certified copy of this order, the respondent no. 2 shall consider and decide the same in accordance with law within a further period of one month.
It is made clear that the court has not adjudicated the claim of the petitioner on merit.
