The sole relief claimed in the instant petition is for issuing a direction to the Prescribed Authority, before which Release Case No. 29/2012 is pending, to decide the same, within a specified time frame.
The proceedings in question are under Section 21(1)(b) of U.P. Act No. 13 of 1972. A perusal of the order sheet reveals that the proceedings which were earlier dismissed in default were restored by order dated 4.12.2018. On 30.1.2019, the Court has issued notice to the opposite party. It is not clear whether the opposite party has been served in pursuance of order dated 30.1.2019 or not.
Having regard to the above facts, this court is not inclined to issue any direction in the instant matter, but leaves it open to the petitioner to pray for expeditious disposal of the proceedings before the Court below itself, soon after the opposite party is served in compliance of order dated 30.1.2019.
The petition stands disposed of as above.
