Heard Sri Sanjay Kumar Pandey, learned counsel for the petitioner, Sri Pramod K. Gupta, Advocate holding brief of Sri Tabish Sheikh, learned counsel representing respondent nos. 5 and 6 and Sri Rajeev Singh, learned Standing Counsel appearing for respondent nos 1 to 4.
Sri Gupta has placed the instructions received from the Executive Officer, Nagar Plika Parishad, Deoband, District Saharanpur and has submitted that the construction of the water tank and public toilets is for the benefit of the people attending 'Mela', which continues for three weeks. The said construction is being raised over State land and not on the land of any private person. He also submitted that this petition is a mala fide petition.
In view of the above, we do not find any merit in this petition to seeking issue directions to restrain the respondents from raising the construction of the water tank and public toilets.
The petition is, accordingly, dismissed.
