Instant writ petition has been filed against the order imposing penalty upon the petitioner, a government servant.
Leaned Standing Counsel at the outset points out that the appellate order is revisable under Rule 13 of U.P. Government Servant (Discipline and Appeal) Rules, 1999.
This fact is not being disputed by the learned counsel for the petitioner.
In view thereof, the writ petition is disposed of as withdrawn with liberty to the petitioner to take remedy before the revisional authority, in accordance with law. In the event, petitioner approaches the revisional authority by way of representation, it is expected that the same shall be considered and decided on merits and shall not be rejected on the ground of laches.
