Rajeesh Babu vs Sri.Selvaraj

High Court Of Kerala|28 October, 2014
|

JUDGMENT / ORDER

The petitioner has approached this Court alleging contumacious act on the part of the respondent, in so far as the direction given by this Court as per Annexure A judgment dated 11.2.2011 in W.P.(C). No. 4432 of 2011 has not been complied with.
2. The learned Government Pleader submits that, the case is not liable to be entertained, for the fact that, it is barred by limitation by virtue of the mandate under Section 20 of the Contempt of Courts Act.
3. This Court finds that, the issue with regard to the plea of limitation had come up before a Full Bench of this Court. Relying on the decision rendered by the Apex Court, it was held in Damodaran v. Cherkalam Abdulla 2007 (2) KLT 171 (FB) that, Contempt of Court case has to be filed within 'one' year, to be in conformity with the mandate of Section 20 of the Contempt of Courts Act.
In the said circumstance, this contempt matter is dismissed as belated.
P.R. RAMACHANDRA MENON, JUDGE.
