The grievance of the petitioners is that the Land Development Committee of Sonebhadra is constructing a road through the plot of the petitioners without taking recourse to any of the acquisition procedure prescribed by law.
Learned Counsel appearing for the respondents states that in case such an application is filed by the petitioners before the District Magistrate, Sonebhadra for redressal of this grievance, it shall be decided at an early date.
The writ petition is, accordingly, disposed of with a direction to the District Magistrate, Sonebhadra that if an application is filed by the petitioners for the aforesaid grievance, it shall be decided expeditiously and preferably within a period of two months from the date a certified copy of the order is submitted with the application after hearing the parties concerned including the Land Development Committee.
It is made clear that the Court has not adjudicated on the merits of the case, and it would be for the District Magistrate, Sonebhadra to decide the application in accordance with law.
