Rajesh Yadav vs State Of U P And Others

High Court Of Judicature at Allahabad|25 July, 2019
|

JUDGMENT / ORDER

Court No. - 44
Case :- CRIMINAL MISC. WRIT PETITION No. - 10587 of 2019 Petitioner :- Rajesh Yadav Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Aishwarya Pratap Singh Counsel for Respondent :- G.A.,Hitesh Pachori,Surendra Narayan Mishra
Hon'ble Ramesh Sinha,J. Hon'ble Raj Beer Singh,J.
Case called out in the revised list. None appears on behalf of the petitioner to press the present writ petition. Sri Rakesh Pande, learned counsel for the respondent no. 3 is present along with Sri Shri Narain Mishra, learned AGA for the State.
This writ petition has been filed by the petitioner with the prayer to quash the FIR dated 20.03.2019 which has been registered as Case Crime No. 300 of 2019, under Sections 498A, 420, 323, 504, 506 I.P.C. and 3/4 D.P. Act, Police Station-Kotwali Nagar, District Etah.
From a perusal of the record it appears that the matter being matrimonial in nature, was referred to the Mediation and Conciliation Centre of this Court vide order dated 23.04.2019. The report of the Mediation and Conciliation Centre dated 21.05.2019 is on record, from which it is evident that the petitioner has not complied with the order dated 23.04.2019 by which he was required to deposit Rs. 50,000/- towards the Mediation and Conciliation Centre for the mediation process, hence, the mediation has failed.
The present writ petition lacks merit and is, accordingly, dismissed.
Interim order, if any, stands vacated.
(Raj Beer Singh, J.) (Ramesh Sinha, J.) Order Date :- 25.7.2019 Anand
