Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the State respondents and perused the record.
Present petition has been filed with a prayer to direct the respondent no. 2 to decide the representation/complaint dated 5.2.2019 filed by the petitioner expeditiously.
Learned Standing Counsel submits that the complaint filed by the petitioner in not in accordance with Rule 3 of U.P. Panchayat Raj (Removal of Pradhan and Up Pradhan) Enquiry Rules, 1997 as the complaint is not supported by affidavit of other persons as required under the Rules.
In such view of the matter, no mandamus as has been prayed for can be issued.
Present petition is accordingly dismissed, however, with liberty to the petitioner file fresh complaint in accordance with Rule 3 of the Enquiry Rules, if he so desires.
No order as to costs.
