The office report dated 24.03.2018, which is based on a tracking report obtained from the Post Office, states that the notice of this transfer application has been delivered upon the opposite party.
Despite notice, none has appeared nor any appearance has been filed by the opposite party. No counter affidavit is available on record.
This is a transfer application by the wife seeking transfer of a divorce petition, filed by the husband at Moradabad. The applicant seeks transfer of this case to District Baghpat.
In the transfer application, it has been averred that the applicant is wholly dependent upon her brother for her maintenance as also that of her daughter and she has no independent source of income.
In paragraph 15 of this transfer application, it has been averred that a case under Section 125 Cr.P.C. has been filed by the applicant and the same is pending consideration at Baghpat.
In the absence of any counter affidavit, the averments made in the transfer application stand uncontroverted and must necessarily to be accepted as correct.
In my considered opinion, all cases between the parties should be decided at one place.
The transfer application is therefore, allowed.
Divorce Suit No. 41 of 2011 (Ranveer Singh Vs. Smt. Rajesh) pending before the Family Court Moradabad shall stand transferred to District Baghpat, forthwith.
